Terms of Sale

These general terms and conditions apply to all purchases made in the online store guernika.eu. They are drawn up in accordance with the Slovenian Consumer Protection Act (ZVPot-1), the Obligations Code (OZ) and applicable European Union consumer law. The online store guernika.eu is owned and operated by Varnas & Sole d.o.o. (hereinafter: “the seller”, “we”).

1. Seller

Full company details are listed in the Legal Notice.

2. Ordering and conclusion of the contract

The store is available in English, 24 hours a day. Registration is not required. If an item you are looking for is not listed, write to info@guernika.eu to check availability.

1. Choose a product and size and add it to your cart. Items can be removed or quantities changed in the cart at any time before payment.
2. Select “Checkout”. You are taken to our payment provider (Stripe), where you enter your contact, delivery and payment details. Before paying you will see the total price including VAT and delivery.
3. By selecting the payment button you place a binding order with an obligation to pay.
4. The purchase contract is concluded when your payment is successfully completed. We then send an order confirmation to your e-mail address, which includes these terms and information on your right of withdrawal.

If, despite successful payment, an item cannot be delivered (for example because of a technical error in stock availability), we will inform you without delay and refund the full amount paid within 14 days at the latest.

The contract is stored in electronic form in our records and in the confirmation e-mail sent to you. The invoice is sent electronically.

3. Prices

All prices are in euros (EUR) and include VAT. Delivery within the European Union is free of charge. The price that applies is the price shown at the time you place your order; later price changes do not affect orders already placed.

4. Payment

Payment is made by card, Apple Pay or Google Pay through Stripe. Card details are entered directly with Stripe; we do not receive or store your full card number.

5. Delivery

We deliver within the European Union through GLS parcel lockers. Dispatch times, delivery times and other details are described in our Shipping Policy. The risk of loss or damage passes to you when you, or a person you designate, take physical possession of the goods.

6. Order cancellation

If you wish to cancel an order that has not yet been dispatched, write to info@guernika.eu or by post to our address. We will cancel the order and refund the full amount. Once an order has been dispatched, you may withdraw from the contract as described in section 7.

7. Right of withdrawal (returns)

As a consumer you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party you designate, take physical possession of the goods. 8. Liability for non-conformity (complaints)

We are liable for any lack of conformity of the goods in accordance with ZVPot-1. If you discover a defect, notify us at info@guernika.eu or by phone at +386 69 758 517, describing the defect and, if possible, attaching photographs. A lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery.

Depending on the case, you may request that the goods be brought into conformity (repair or replacement), a proportionate price reduction, or termination of the contract and a refund, as provided by law.

If a parcel arrives visibly damaged, we kindly ask you to tell us as soon as possible so that we can claim it with the courier. This request does not limit your statutory rights.

Liability for non-conformity does not cover wear and tear from normal use, or damage caused by improper use, failure to follow the care instructions, or modification of the product after delivery. We do not offer a commercial guarantee in addition to your statutory rights.

9. Product information

We do our best to describe and photograph our products accurately. Colours may appear slightly different depending on your screen. Each piece is part of a numbered, limited edition, so quantities are strictly limited.

10. Personal data

We process personal data in accordance with the General Data Protection Regulation (GDPR) and the Slovenian Personal Data Protection Act (ZVOP-2). Details are in our Privacy Policy.

11. Out-of-court dispute resolution

We try to resolve every complaint amicably — please contact us first at info@guernika.eu. In accordance with the Slovenian Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS), Varnas & Sole d.o.o. does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve consumer disputes. This does not affect your right to bring a claim before a competent court.

12. Applicable law

These terms are governed by the law of the Republic of Slovenia. If you are a consumer residing in another EU country, you keep the protection of the mandatory consumer law of your country of residence.

13. Changes to these terms

We may update these terms from time to time. The version published at the time you place your order applies to that order.
